Terms and Conditions

Acceptance of Terms: Welcome to the website of Alchemist Advanced Technologies (operating via alchemisttech.co) – referred to as “Alchemist Technologies,” “we,” or “our.” By accessing or using our website or any of our software solutions, digital services, IT infrastructure offerings, or related services (collectively, our “Services”), you agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully. If you do not agree with any part of these Terms, you must not use this website or our Services.

Company Overview: Alchemist Advanced Technologies is a technology-focused business providing software solutions, digital services, cloud and IT infrastructure support, and other related offerings to clients. These Terms govern your use of our website and any Services provided through it, except to the extent such Services are covered by a separate written contract as described below.

Modification of Terms: We reserve the right to update or modify these Terms at any time. Any changes will be effective once posted on this page with a revised “Last Updated” date. It is your responsibility to review these Terms periodically for updates. Your continued use of the website or Services after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should discontinue use of our website and Services.

Additional Agreements: In some cases, you may enter into a separate agreement with Alchemist Technologies (for example, a master services agreement, proposal, or contract) for specific Services or projects. Such agreements may contain terms that supersede or supplement these Terms. In the event of any conflict between these Terms and a separately signed contract between you (or your organization) and Alchemist Technologies, the terms of the signed contract will prevail for the Services in question. Additionally, our Privacy Policy (if provided separately) will govern how we collect and use personal information; by using our site, you acknowledge that you have read and understood our privacy practices.

Use of the Website and Services

Eligibility and Authority: You represent that you are at least 18 years old or the legal age of majority in your jurisdiction, and legally capable of entering into binding agreements. If you are using the website or Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, “you” and “your” will refer to the entity you represent as well as yourself as an individual.

Permitted Use: We provide our website and content for your informational and business use in connection with our Services. You may use the site to learn about our solutions, request information, and, where applicable, engage in transactions (such as purchasing services or registering domains) offered by Alchemist Technologies. You agree to use the website and Services only for their intended purposes and in compliance with all applicable laws and regulations. You may download or print materials from the site for your personal or internal business use only, provided that you do not remove any proprietary notices or logos. Any other use of the content on our site (such as reproduction for commercial purposes unrelated to engaging our Services) is prohibited without our prior written consent.

Site Availability: We aim to keep our website operational and accessible, but we do not guarantee uninterrupted access. We may occasionally suspend, withdraw, or restrict the availability of all or part of our site for maintenance, updates, or other business reasons. We will try to give advance notice of any significant downtime, but we are not liable if the site is unavailable at any time or for any period. You are responsible for making sure that all persons who access our site through your internet connection are aware of these Terms and comply with them.

User Accounts and Security

Account Creation: Some of our Services (for example, managing domain registrations, cloud services, or accessing special client portals) may require you to create an account or provide login credentials. When you create an account, you agree to provide accurate, current, and complete information about yourself (or your organization) as prompted, and to update such information promptly if it changes. We reserve the right to suspend or refuse account registration if we suspect the information provided is false, fraudulent, or violates these Terms.

Account Responsibility: If you create an account or are provided with login credentials, you are responsible for maintaining the confidentiality of your username, password, or other security information. You agree not to share your account credentials with any unauthorized person. You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or a security breach, you must notify Alchemist Technologies immediately at connect@alchemisttech.co. We are not liable for any loss or damage arising from your failure to keep your account credentials confidential.

Account Termination: We may terminate or suspend your user account and access to the Services (without liability) at any time if, in our reasonable opinion, you have violated these Terms, engaged in fraudulent or unlawful activities, or posed a security risk. (See also the Termination section below for more details.)

Acceptable Use and User Obligations

When using our website and Services, you agree to the following acceptable use terms. You shall NOT:

  • Engage in Unlawful or Prohibited Activities: You will not use the site or Services for any purpose that is illegal, fraudulent, or not permitted by these Terms. This includes, but is not limited to, violating any applicable local, national, or international laws or regulations while using our site.
  • Interfere with the Website: You will not attempt to interfere with the proper functioning of our website or Services. Prohibited conduct includes introducing viruses, worms, malware, or any other harmful code; launching any denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks; attempting to probe, scan, or test the vulnerability of our systems or networks; or breaching any security or authentication measures without proper authorization.
  • Unauthorized Access: You will not attempt to gain unauthorized access to any portion of the site, other user accounts, or any systems or networks connected to the site, through hacking, password mining, or any other illegitimate means. Similarly, you will not impersonate any person or entity or misrepresent your affiliation with any person or entity when using our site or communicating with us.
  • Misuse of Content: You will not copy, scrape, extract, modify, distribute, or create derivative works from our website content (including text, graphics, logos, software code, and layout) except as expressly permitted by these Terms or with our written permission. Also, you may not use any automated means (such as bots or crawlers) to access or collect data from our site without our prior consent (standard search engine indexing is allowed).
  • Abusive Behavior: You will not use the site to transmit or post any material that is defamatory, harassing, threatening, abusive, obscene, vulgar, offensive, or otherwise objectionable. You will not harass or harm other users or our staff, and you will not spam our contact forms or other communication channels with unsolicited or irrelevant requests.

User-Provided Content: If you submit information or materials through our website (for example, by filling out a contact form, commenting on a blog post, or providing feedback/testimonials), you must ensure that such content is accurate, lawful, and does not infringe any third-party rights. Unless otherwise stated, any content you submit to us through the website (excluding personal information provided for service inquiries, which is handled under our privacy practices) will be considered non-confidential and non-proprietary. We reserve the right to use, reproduce, or display such non-confidential feedback or submissions for our business purposes (for example, improving Services or marketing), without owing you any compensation. We may remove any user-submitted content from our site at our discretion if we believe it violates these Terms or is otherwise objectionable.

Consequences of Violation: Violation of this Acceptable Use section may result in suspension or termination of your access to the site or Services, and if relevant, legal action against you. You agree that we may investigate any suspected violations and cooperate with law enforcement or regulators in prosecuting users who violate these Terms.

Intellectual Property Rights

Ownership of Website Content: All content on the Alchemist Technologies website – including but not limited to text, descriptions, data compilations, graphics, logos, icons, images, videos, software code, design/layout, and overall look & feel – is the intellectual property of Alchemist Advanced Technologies or its licensors and is protected by copyright, trademark, and other intellectual property laws. Alchemist Technologies retains all rights, title, and interest in and to its intellectual property.

Trademarks: The trademarks, service marks, trade names, and logos displayed on our site are registered and unregistered marks of Alchemist Advanced Technologies or our partners. “Alchemist Advanced Technologies,” “Alchemist Technologies,” and our logo are proprietary trademarks of our company. All product and company names (such as Zoho, Odoo, Gallabox, Zuper, Shopify, Monday.com, etc., mentioned on our site) are trademarks of their respective owners. Use of these names on our website is for identification of compatibility or partnership and does not imply any affiliation with or endorsement by the trademark owners, other than as explicitly stated (e.g., being an authorized partner or reseller). Nothing in these Terms or on our website grants you any license or right to use any trademarks displayed on the site without the owner’s prior written permission.

Limited License to Users: Alchemist Technologies grants you a limited, revocable, non-exclusive, non-transferablelicense to access and make personal or internal business use of our website and its content for the purposes of evaluating our Services or conducting business with us. Under this license, you may not: (a) resell or commercially exploit our website content without permission; (b) make any derivative works or modifications of the content; (c) download or copy account information or content for the benefit of another merchant or competitor; or (d) use data mining, robots, or similar data gathering tools to extract content, except as allowed by a search engine following robots.txt guidelines. Any unauthorized use of the website or content will terminate the permission or license granted by these Terms and may infringe upon our intellectual property rights.

Feedback and Suggestions: We welcome feedback, ideas, or suggestions from users about how to improve our Services or website. However, please note that if you voluntarily provide us with any suggestions, ideas, or other feedback, you agree that such submissions are unsolicited and delivered without any obligation of confidentiality. We shall be free to use, disclose, and implement any such feedback without restriction or compensation to you, and you irrevocably assign to us all right, title, and interest in and to such feedback.

Third-Party Links and Services

External Links: Our website may contain links to third-party websites or resources for your convenience (for example, links to software principals or partners, industry articles, or social media pages). These external sites are not under the control of Alchemist Technologies. We do not endorse and are not responsible for the content, products, services, or information on any third-party websites. If you decide to access any third-party links, you do so at your own risk. We strongly advise you to review the terms and conditions and privacy policies of any third-party websites that you visit through links on our site, as their policies will differ from ours.

Third-Party Integrations: As a technology solutions provider, Alchemist Technologies often works with or resells third-party software and services (for instance, we are a trusted partner for platforms like Zoho and Odoo, among others). Any third-party software, platform, or service that we help implement or integrate for you will also be subject to the third party’s own license agreements, terms of service, and/or privacy policies. For example: if we assist you in setting up a Zoho product, you will likely need to agree to Zoho’s terms of service for that product. While we facilitate and support your use of such third-party services, we do not own or control those services, and we make no warranties or representations regarding any third-party product’s performance or reliability beyond those made by the third-party provider.

No Liability for Third Parties: You agree that Alchemist Technologies is not responsible or liable for any loss or damage of any sort incurred as the result of your dealings with any third parties, even if you learned about or accessed them through us. This includes any transactions you conduct with third-party vendors (such as purchasing licenses or subscriptions) or any support issues arising from third-party products. Any dispute you have with a third-party provider is between you and that provider, and you release Alchemist Technologies from any claims or damages arising out of such disputes. That said, if you encounter an issue with a third-party product integrated by us, we will endeavor to assist or direct you to the appropriate support channel as part of our service commitment, but ultimate responsibility lies with the third-party provider as per their terms.

Online Payments and Orders

Payment Processor: For your convenience, we may offer online payment facilities on our website (for example, to pay invoices, purchase software subscriptions, register domains, or other Services). Our online payment system is provided by a third-party payment gateway (such as PayTabs or a similar payment processor). When you make a payment through our website, you will be redirected to or making use of this secure payment gateway. Please note: The payment processor may have its own terms and conditions governing the use of their service. We have no control over their internal terms, and they may change from time to time. By using our online payment facility, you agree to abide by the payment processor’s applicable terms and not hold us liable for their actions. We strive to use reputable, secure payment providers to safeguard your financial information.

Order Acceptance and Confirmation: Any purchase or order you place through our website (or via communication initiated on our site) is an offer by you to buy the indicated product or service under these Terms. All orders (including domain registrations, service subscriptions, or any deliverable) are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including inaccuracies in pricing or availability information, or suspected fraud. No order shall be considered accepted by Alchemist Technologies until we issue a confirmation (e.g., an email confirmation, invoice, or delivery of the service/product). If we cancel an order after you have already made payment, we will provide you a full refund of that payment, unless the cancellation was due to a violation of these Terms or unlawful activity.

Pricing and Taxes: All prices for our products and Services will be as specified on the website or in a proposal/quote provided to you. Prices are listed in the relevant currency (our primary operating currency is often UAE Dirhams or U.S. Dollars, unless otherwise stated). Prices may be subject to applicable taxes (for example, UAE VAT at the prevailing rate, or other sales taxes) depending on your location and the nature of the product/service. Unless clearly stated, prices listed do not include these taxes. You are responsible for any taxes or duties applicable to your purchase. We reserve the right to change prices for our Services at any time; however, such changes will not affect any order that has already been confirmed.

Payment Terms: Payment for any order must be made in full at the time of order (unless we explicitly agree in writing to invoice you with payment terms). We accept payment via credit card, debit card, and/or other electronic payment methods as indicated on our site or invoice. By submitting payment information, you represent that you are authorized to use the payment method and you authorize our payment processor to charge the full amount to the card or account you provide. All payments must be made in the currency specified. If your payment is subject to currency conversion or bank fees, you are responsible for those costs.

Card Payments: If you are paying by credit or debit card, the charge will be processed via our payment gateway provider under secure encryption (see Security section below). All payments are subject to the following conditions:

  • If your card issuer or bank declines the payment, we have no obligation to notify you of the failure. It is your responsibility to ensure that the payment has been successfully processed. You should check with your bank or card provider if you are uncertain whether a payment has been deducted from your account. If we do not receive the payment due to a declined transaction, we will not process your order or provide the Service, and it remains your responsibility to arrange alternative payment.
  • Accuracy of Payment Information: You must provide accurate billing information and a valid payment method. If the information you provide is incorrect or incomplete, we may not be able to process your order or contact you. Alchemist Technologies is not responsible for delays or non-delivery of Services caused by your failure to provide correct payment details.
  • Payment Confirmation: After a successful online payment, you should receive a confirmation on-screen and/or via email. This confirmation will serve as your receipt. If you do not receive confirmation but believe payment was made, contact us at connect@alchemisttech.co for verification before attempting a duplicate payment, to avoid double charges.

Invoices: For certain Services (especially B2B services or projects), we may issue an invoice to you, payable within a specified time frame (e.g., net 15 or net 30 days). The terms of such invoicing (due date, milestones, etc.) will be defined in the applicable Service Agreement or invoice document. If you fail to pay an invoice by its due date, we reserve the right to suspend or terminate the corresponding Service after giving notice and an opportunity to cure the non-payment. Late payments may incur interest or late fees as per the terms of the invoice or allowed by law.

Fraud Prevention: All payment transactions are subject to verification and anti-fraud screening. We reserve the right to refuse to process a transaction or provide a Service if we suspect fraud, unauthorized use of payment methods, or violation of these Terms. Alchemist Technologies will not be liable for any delay or refusal to process an order if we reasonably suspect the transaction may be fraudulent or illegal. We may contact you to verify your identity or payment details as part of our verification process.

Changes to Services

Our business and the technology industry are dynamic. We reserve the right to modify, update, or discontinue any part of our Services or website content at any time:

  • Service Changes: We may add new features or remove existing features. We may offer new services or discontinue old ones. For example, if we offer a particular integration and later find a better alternative, we might phase out the old integration. We strive to improve our offerings, and that inevitably means changes will occur. We will endeavor to inform users (especially paying clients) of any material changes that might affect them, giving advance notice where practical. However, we are not obligated to maintain any feature or service for a minimum duration unless explicitly stated in a contract.
  • Beta Features: If we label something as “beta,” “preview,” “pilot,” or similar, it means that feature is in testing phase and offered on an as-is, as-available basis, without any promises of full functionality or support. We might change or remove beta features more frequently as we iterate on them. Your feedback on such features is appreciated but usage is at your own risk given their experimental nature.
  • Website Content Updates: Content on our website (such as blog posts, product descriptions, FAQs, etc.) may be updated from time to time to reflect changes in our services or policies. We might also remove content that is out-of-date. These content updates do not necessarily equate to a change in Terms, but are part of keeping the informational aspects of our site current.
  • Technical Requirements: As technology evolves, you may need to ensure you have compatible technology to continue using certain Services. For instance, we might update a software’s supported browser list or required minimum system requirements. We will try to mention such requirements on our site or notify users if a change will render older systems incompatible.

Our business and the technology industry are dynamic. We reserve the right to modify, update, or discontinue any part of our Services or website content at any time:

Your Options: If you don’t like a change in the Services, you are free to stop using the affected Service. If you have prepaid for a service that is significantly altered or discontinued, you may be entitled to a refund for the unused portion (see Refund Policy). We aim to treat such situations fairly (for example, if we shut down a cloud service that you paid a year in advance for, we would refund the remaining unused months). We will communicate how we intend to wind down any deprecated service in such cases.

Please note that these Terms themselves (the legal language) can be updated as described in the Introduction. This Changes to Services section is more about the functional or content changes in our offerings, not the legal terms.

Governing Law and Jurisdiction

Governing Law: These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or formation, shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE). We choose UAE law given our significant presence in Dubai, UAE. If you are using our Services from another country, please be aware that you may also have rights under your local laws; however, to the extent permitted, UAE law will apply to the interpretation of these Terms and any disputes between us.

Jurisdiction: You agree that the courts of the United Arab Emirates (specifically, the courts of Dubai) shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter. You and Alchemist Advanced Technologies both consent to the personal jurisdiction of such courts. This means if a dispute can’t be resolved amicably, it will be brought before a court in the UAE (in Dubai, if permissible) for resolution according to UAE law.

Waiver of Other Venues: By agreeing to this jurisdiction clause, you waive any objection to the UAE courts handling the dispute, whether on the grounds of inconvenient forum or otherwise. If you are in a different country, you also agree not to pursue legal action against us in the courts of any other country (unless required by a compulsory law that overrides this agreement). Conversely, we agree the same – we will bring any claim against you in the UAE courts and not elsewhere, provided this clause is enforceable.

Local Law Requirements: We recognize that our website might be accessed from anywhere in the world. If you access the site from outside the UAE, you do so on your own initiative and are responsible for compliance with local laws if and to the extent local laws are applicable. We make no representation that materials on our site are appropriate or available for use in other locations. You should not use the site or Services in violation of export laws or regulations. If you are in a jurisdiction that does not permit the choice of UAE law or the exclusive jurisdiction of UAE courts for certain types of disputes (for example, certain consumer protection claims), then your local law may apply to that extent, but all other provisions will remain in effect.

Government and Regulatory Requests: In the event we are required to respond to a legal request (such as a subpoena, court order, or government demand) in a jurisdiction, that does not waive our right to have disputes heard in UAE courts; it’s simply compliance with legal process. The governing law and jurisdiction for interpreting these Terms remain as stated.
